Car accidents can result in a variety of injuries, ranging from minor to severe. Understanding the common types of injuries and their impact is essential to recognize symptoms and seek appropriate medical care.

2. Traumatic Brain Injuries (TBIs): TBIs occur from a blow or jolt to the head and can range from mild concussions to severe injuries. Symptoms include headaches, dizziness, and memory loss. Prompt medical attention is essential to prevent further damage.

3. Spinal Cord Injuries: These injuries can lead to partial or complete paralysis. Symptoms include numbness, weakness, and loss of sensation in limbs. Immediate medical intervention is crucial to maximize recovery.

4. Broken Bones and Soft Tissue Injuries: Accidents can cause fractures or soft tissue injuries like sprains and strains. Early diagnosis and treatment are vital for recovery.

Understanding liability in car accidents is essential for securing compensation. Liability is determined by examining several factors, including traffic laws, driver behavior, vehicle defects, and road conditions. ‍ 1. Traffic Laws and Regulations: Violation of traffic laws, such as speeding or running a red light, can establish negligence and liability. Documentation like police reports and witness statements can support your claim. 2. Driver Behavior: Reckless driving behaviors, like texting or driving under the influence, can determine fault. Evidence like cell phone records and surveillance footage can help prove liability. 3. Vehicle Defects: Sometimes, accidents are caused by defects in the vehicle. In such cases, the manufacturer could be held liable for damages. 4. Road Conditions: Hazardous road conditions like potholes or inadequate signage can also contribute to accidents. Liability may fall on government agencies or private entities responsible for road maintenance. Determining liability requires a thorough investigation of the accident’s circumstances. A personal injury attorney can help you gather evidence, build a strong case, and pursue the compensation you deserve.

Knowing your rights is crucial to ensure fair compensation and protection. ‍ 1. Seeking Medical Attention: After an accident, prioritize medical attention, even if you feel fine. Keep thorough records of all medical treatments and expenses to support your claim. 3. Knowing this information will help you navigate the claims process more effectively and avoid disputes with your insurance company. 4. Traumatic Brain Injuries (TBIs) can turn a person’s life upside down, affecting their health, career, and overall well-being. When these injuries are caused by someone else’s negligence—whether in a car accident, slip and fall, or another incident—victims have the right to seek compensation. Understanding the types of damages you can claim is essential to securing a settlement or verdict that truly reflects the impact of the injury on your life. At Maximus Law, our dedicated team is here to champion your rights, guide you through the various types of claims, and help you secure the compensation you deserve. Types of Damages You Can Claim Medical Expenses Victims should not have to face the overwhelming additional financial burden of medical treatment for TBIS on their own, especially for severe injuries requiring ongoing care. That’s why it’s crucial to document all medical expenses, including receipts, bills, and treatment plans. As thorough documentation will strengthen your case and ensure all financial impacts are addressed. Compensation can cover: Emergency room visits and hospital stays Surgeries and medications Physical, occupational, and cognitive therapy Assistive devices like wheelchairs or home modifications Future medical expenses for long-term care Lost Wages and Earning Capacity Unfortunately, a TBI can significantly impact your ability to work, either temporarily or permanently. While victims are recovering at home, they often lose out on essential income, creating additional financial stress. Compensation for lost wages and diminished earning capacity can help bridge this gap, ensuring you have the financial support needed during recovery and beyond. You can claim damages for: Wages lost during recovery Reduced earning capacity if your injury prevents you from returning to your previous job or working full-time Loss of future income if you’re unable to work again Pain and Suffering TBI often extends far beyond financial costs, leaving victims to cope with significant physical and emotional distress. These challenges can disrupt relationships, hinder personal growth, and diminish overall quality of life. Compensation for pain and suffering may include: Physical discomfort and chronic pain Emotional trauma, including anxiety, depression, or PTSD Loss of enjoyment of life if you’re unable to engage in activities you once loved Loss of Community TBIs can also deeply affect your relationships, as the injury places significant strain and added pressure on your family members and friends. The changes in your behavior, mood, and abilities can be challenging for loved ones to navigate, leading to feelings of frustration, helplessness, and emotional exhaustion. Therefore, family members, spouses, children, or parents may be entitled to damages for the loss of companionship, care, or support caused by your injury. How to Maximize Your Compensation To ensure you receive fair compensation, it’s essential to: Seek immediate medical attention and follow all recommended treatments. Document everything, including medical expenses, lost income, and changes to your daily life. Consult an experienced personal injury attorney who understands TBI cases. An attorney can help gather evidence, negotiate with insurance companies, and, if necessary, represent you in court to fight for the compensation you deserve. Car accidents can have a traumatic impact on any individual, but when the incident involves an intoxicated driver, the situation can be even more overwhelming. In addition to the physical and emotional toll, you may have to navigate complex legal and insurance processes to ensure you receive the compensation you deserve from the liable party. Maximus Law is here to fight for you in every situation and ensure you are fully aware of your legal rights after being involved in a drunk driving accident. We are committed to raising awareness about the serious implications of driving drunk and being your ally during these difficult times. Let’s explore a step-by-step guide on what to do if you’re in volved in a car accident with a drunk driver and how to seek compensation for your injuries and damages. 1. Ensure Safety and Seek Medical Attention Your first priority after any car accident, especially one involving a drunk driver, is your safety and health. If possible, move to a safe location, but only if you can do so without causing further harm to yourself. Then, immediately call 911 to report the accident. Even if you don’t feel injured, it's important to seek medical attention, as many symptoms may not be immediately apparent. 2. Gather Evidence at the Scene While still at the scene of the crime, make sure to gather all possible documentation. Everything you collect will help strengthen your case and serve as crucial evidence later. Here are some steps you should take to collect as much evidence as possible: Take Photos: Make sure you take as many photos as possible of the accident, like vehicle damage, skid marks, road conditions, and any visible injuries. Exchange Information: Get the drunk driver’s name, address, phone number, driver’s license number, insurance information, and license plate number. Witness Statements: Collect all contact information from witnesses and ask if they would be willing to provide statements. Record the DUI Situation: If you can, note the behavior of the drunk driver. If the police make an arrest or administer a breathalyzer test, document this information as it can be crucial in your case. 3. File a Police Report Once the police arrive, they will assess the scene and file an official police report. If the other driver was drinking, the officer would administer a breathalyzer and arrest them for driving under the influence. The official report will be vital for your claim and in determining who is at fault for the accident. It’s important to always ask for a copy of the report, or the report number at the very least, to use in your legal and insurance proceedings in the future. 4. Contact Your Insurance Company Even if the other driver is at fault, you should contact your insurance company as soon as possible to report the accident. Inform them of all the information you have about the situation including the police report number and facts relating to the drunk driver. Your insurer may take responsibility for the claim or attempt to obtain compensation for your injuries and damages from the insurance of the negligent driver. 5. Seek Legal Representation with Maximus Law Dealing with a drunk driving accident can be complicated, especially when seeking compensation for injuries and damages. That’s where Maximus Law can help. Document Your Injuries and Treatment After an accident, it’s crucial to keep thorough records of all medical treatments, diagnoses, and any long-term effects from your injuries. This includes: Doctor visits, surgeries, and rehabilitation appointments Prescription medications Any other treatments related to the accident. This documentation will support your claim for medical expenses and any future costs related to ongoing treatment. 7. Pursue Compensation for Your Injuries Compensation after a car accident involving a drunk driver can include: Medical expenses: This covers emergency care, hospital stays, surgeries, rehabilitation, and any future medical needs related to your injuries. Lost wages: If you missed work because of your injuries, you can seek compensation for the wages you lost, including any potential future income loss if your ability to work is permanently impacted. Pain and suffering: This includes compensation for physical pain, emotional distress, and the loss of enjoyment of life. Property damage: Compensation for the repair or replacement of your vehicle and other damaged property. Punitive damages: In cases where the drunk driver’s actions were particularly reckless, punitive damages may be awarded as a way to deter similar behavior in the future. 8. When I was in high school, I experienced a life-changing event that played a vital role in shaping my career path. A close friend of mine was involved in a severe car accident that took his life away. While this was an immense loss to deal with, I learned that his family had to endure further heartbreak: the attorneys they placed their trust in mishandled the case, leaving them without fair compensation for their suffering. Witnessing this injustice deeply affected me, and from that moment, I knew I wanted to truly make a difference by helping those in need. As I went through college and law school, I kept this commitment close to my heart. At first, I didn’t know if personal injury law would be the right fit. I had also thought about workers' compensation and other areas of law. However, I couldn’t ignore the growing number of people around me—friends, family, and acquaintances—who were involved in accidents and taken advantage of during their most vulnerable moments. This was when I realized I couldn’t sit back and let them face this alone. I decided that I needed to step up and take action. Together with my business partner, someone I’ve been friends with since our freshman year of college, we decided to address this problem head-on. We'd always known we were going to work together; our partnership was built on years of trust and shared ambition. During and after college, we explored various business ventures, from car-buying programs to other entrepreneurial projects, and consistently found success. Yet, it was our shared vision for the legal field that truly aligned with our purpose. We started by referring our personal injury cases to other firms, in an attempt to help our friends and family get the representation they deserved. Unfortunately, we continued to see the same problems over and over again. Too many of these firms neglected their clients, by communicating poorly or mishandling cases, leaving clients frustrated and dissatisfied. This recurring issue sparked a pivotal realization: instead of trusting others to care for these cases, we could do it ourselves—and do it better. We saw an opportunity to provide not only competent legal representation but also the care, respect, and attention that clients deserve during such challenging times. That’s how our journey into personal injury law began. By taking matters into our own hands, we’ve built a firm dedicated to ensuring clients receive justice and fair compensation while knowing they’re supported every step of the way. It’s more than a profession for us—it’s a mission born from personal experiences and a desire to make a meaningful impact.

A good friend of mine came to me with serious concern, as he got into an Uber and Lyft collision, and he had $50,000 on the line. The attorney he was working with at the time was pushing him to take the deal, insisting it was a good amount given the circumstances—minimal impact, a gap in medical treatment, and other factors that could complicate the case. When I reviewed the case, I saw potential that others had overlooked. I told him, “Let me take this case and show you what I can do.” The case was already in litigation, but I took over and pushed forward with determination. Seven months later, after hard work and negotiations, we settled the case for $325,000—more than six times the initial offer. My client walked away with approximately $200,000 in his pocket, and he couldn’t have been happier. This experience showed us that every client should be treated like family. When you show up for every case as if it’s family and are willing to take it as far as necessary—even to trial—the insurance companies take notice. They know the costs of defending a trial can far exceed the settlement amount, and if they believe you’re serious about going all the way, they’re more likely to offer a fair deal to avoid the risk and expense. In this particular case, it wasn’t until just a few days before the trial that the insurance company finally raised their offer to $325,000. By holding firm and refusing to settle for less than what my client truly deserved, we were able to maximize the outcome and secure a result that reflected the value of the case. This is what it means to fight for your clients and see that they get the compensation they deserve. Maximus Law is committed to providing exceptional legal representation for those who need it most. We pride ourselves on treating every client like family, ensuring their voices are heard and their cases are handled with the utmost care and commitment. Our law firm is known to take bold moves when it comes to personal injury law, never shying away from going to trial to secure the best possible outcomes for our clients.

One case that really stands out is a dog bite situation involving two neighbors living in a duplex. The neighbor in the back of the house came to us after being bitten by the dog of the neighbor in the front house and wanted to sue. So, we began by starting the process of pursuing a case against the neighbor in the front house. However, things quickly took an unexpected turn. The neighbor in the front house came to our law firm, angry and demanding to know why we were suing them. We made it clear that we could not discuss the case with them directly, and that what would happen in the legal process would happen regardless of their protests. It was a tense moment, but we stayed firm in our position. Time continued to go on, but the situation only became that much more complicated. The neighbor in the front house escalated things by keying the back neighbor’s car and engaging in property damage disputes. From this point forward, the dog bit was becoming a full-on neighborhood dispute. Tensions continued building up with both parties becoming increasingly hostile toward each other. The challenging part is that this case is still ongoing, and it is just a perfect example of how a simple legal matter can escalate when personal emotions and tensions are involved. But that is the reason why Maximus Law is different. We don’t back down from a challenge, no matter how complicated or heated the situation becomes. Even when people try to intimidate us or derail the process, we remain committed to getting the best outcome for our clients. At Maximus Law, we believe in fighting for justice and standing by our clients every step of the way, no matter how tough the road may get. We understand that the legal process can be a long and stressful journey, but we never give up. We’re in this for the long haul, no matter how messy things get. If you’re facing a difficult legal situation—whether it’s a dog bite case, a neighbor dispute, or anything else—trust that Maximus Law will be there to fight for you. We don’t walk away from challenges; we tackle them head-on with determination and expertise. We’ve got your back, no matter what.
